Google form unlocked
Following the decision of the EuGH of 13.05.2014 (we have reported on this) Google, as a search engine operator, must, within the scope of its powers and capabilities, ensure that its activities are in compliance with the data protection directive. Under certain conditions, Google is therefore obliged to remove links that appear in a search for a person and refer to publications about that person. The search engine operator has now implemented this.
Google has, in light of the decision of the European Court of Justice, now unlocked a form with which one can request the removal of search results.
Users are thereby granted the right to request the removal of search results from Google, provided that these results, in view of all the circumstances of the individual case, in particular the time that has elapsed, do not correspond to the purposes for which they were processed, are not or are no longer relevant for those purposes or go beyond them.
Google notes that a request for deletion does not automatically result in deletion of the content. Rather, the search engine operator performs an appropriate review. Applicants must therefore substantiate their requests for deletion of each individual link. Furthermore, the uploading of a copy of a national identity card or other travel document is required to prevent abuse of the function.
Conclusion
